Third
Message To Plaintiffs
Editor’s note: The following message is the 3rd in a series and was e-mailed
today to all the people who have indicated an interest in becoming a member
of the plaintiff class in the Right to Petition Lawsuit.
For
scheduling purposes, please note that the events of July 19th at
the National Press Club in Washington, DC are scheduled to start at 9 AM and
end by 5 PM.
All
attending are asked to be settled into their seats at the National Press Club
by 8:45 AM.
We
have received a
response from
the White House to our May10th
letter to President Bush and
Senator Kerry. We have not received a response from Treasury Secretary Snow,
Attorney General Ashcroft or IRS Commissioner Everson.
Should
any of the officials attend, or send representatives, they will be given the
opportunity to address the issues and answer the questions presented in our
Petitions for Redress of Grievances relating to the Income Tax and the Iraq
Resolution.
Regardless, two constitutional scholars and Mark Lane will speak on the
subject of the Right To Petition before we march to the District Court to
file our motion for injunctive relief.
The
National Press Club is located at 529 14th Street, NW, Washington
DC, which is on the corner of “F” Street. The nearest Metro Stop is “Metro
Center.”
Bill’s Bus
Bill
Stegmeier, our state coordinator in South Dakota, is putting together a
chartered bus trip to DC. The bus will be traveling I-80 to Chicago, down to
I-70 and on to DC.
Anyone
along the route from SD to DC that may need a ride, should call Bill at
605-368-2780.
Bill
has a good idea. We ask everyone, especially our county and state
coordinators, to contact his or her local bus company. Obtain a quote for
chartered bus trip to DC and back, spending a minimum of one day in DC.
Determine the number of seats and the time and location for departure.
Please do this immediately. Email the info to

We will post the details and send them to everyone on our full mailing list
to urge them to “pick a bus” from the list.
Today’s buses have all the comforts of home (well almost) and are equipped
with DVD, CD and tape players to educate and entertain.

For
those who decide to travel by car and who have room for passengers, we ask

departure and what route to DC they will be taking. Please do this

Two

Stats
So
far, so good. As of Tuesday afternoon, people from 33 states have declared
they will be in DC for the July 19th events.
It
will be very important to be able to say that we have a delegation of people
from all 50 states in DC in support of the filing of the motion to enjoin
the IRS and the DOJ from engaging in any further enforcement actions against
the plaintiffs until the questions underlying our complaint are determined
by the court.
Thus
far, the following states are un-represented: Alabama, Alaska, Connecticut,
Delaware, Hawaii, Idaho, Indiana, Kansas, Louisiana, Nebraska, North Dakota,
Oklahoma, Oregon, Utah, Vermont, W. Virginia, and Wyoming.
Deception
On
June 28th NewsWithViews posted an
article
titled, “Right To Petition Lawsuit Dismissed.”
As
will be shown below, this headline appears to be nothing more than a thinly
veiled attempt to dilute and diffuse support for the upcoming July 19th
WTP events and Right to Petition class-action lawsuit. The author herself
admits (near the end of the lengthy article) that the case she is writing
about is not about the Right to Petition.
From
the article we see it is about a California man who filed a case in federal
court for a Writ of Mandamus, asking the court to order the Governor to
provide his definition of the Right to keep and bear arms. The federal court
dismissed the case (he should have filed in state court). An appeal was
taken to the federal court of appeals where it was, of course, dismissed
without opinion. The U.S. Supreme Court was asked to hear the case. It
refused to do so. The man then went back to the federal court of appeals
where he lodged a complaint against the three judges who dismissed his
appeal without opinion, charging them with violating his “civil right to
petition for redress.” That complaint was likewise dismissed, as it should
have been. An appeals court does not have to give a reason for affirming a
lower court’s dismissal, especially in an action that is clearly frivolous
and where the court does not have any jurisdiction.
The
author’s assertion that ordinary people can defend their Right to Petition
by filing a “simple” Order to Show Cause for $300 is highly misleading.
Orders
to Show Cause don’t cost anything. It costs approximately $300 to initiate a
lawsuit. Once the complaint is filed, the court can be motioned to hear the
case earlier than the normal return date, say in seven days rather than 28
days. An Order to Show Cause is simply a form of motion to move up the
initial hearing date. Judges often deny requests for an Order to Show Cause,
seeing no urgency to bring the case on earlier than normal. Regardless, once
the case is on the court’s calendar, the parties go at it hammer and tong.
Lots of papers (Briefs, Affidavits, Motions, etc.) get filed, discovery
procedures are often engaged in, trials are conducted, interim decisions are
often rendered, appeals are made to higher courts, remands can occur, final
decisions are rendered, followed by more appeals.
For
the record, the papers and legal arguments to be filed in our Right To
Petition lawsuit, will be anything but “the usual briefs.”
Granted, NewsWithViews publishes opinion pieces and has the right to do so,
but its credibility and journalistic integrity “take it on the chin” when it
publishes articles about such trivial matters as the California case, a case
of virtually no interest to its readers. The article begs the question,
“What was the real motive behind the publication of this article?”
