In the latest move by the NYBOE to halt the proceedings which are getting too close for their comfort, the lower court dismissed the case -- after 4.5 years in process -- due to lack of standing. Plaintiffs Schulz and Liggett have appealed the case to the Second Circuit in Manhattan. All important appeals brief due Feb 14th.
The case began in 2007 and seeks to ban the use of electonic, lever or any other sort of voting machine in New York State to record and count votes. Based on the constitutional principle of the Public Nature of Elections, Voters Schulz and Liggett stand on their Right to Know that their votes are being counted accurately, which they cannot know when voting machine systems are used. They seek a return to public elections which are truly "public" - i.e. open, verifiable or transparent throughout the process, i.e. in full public view.
