Eight counties in Arkansas are granted by petition to obtain signatures for legalization of gambling establishments. Under Arkansas Code Annotated 7-9-503 an Arkansas taxpayer and voter can petition the secretary of state regarding the legality of statewide initiative petitions. The secretary of state would then decide in consultation with the attorney general whether a proposed measure would violate the state or federal constitutions, or would be invalid for any other reason if it was enacted. Constitutional amendments placed on the ballot could also be challenged in the Arkansas Supreme Court.
Valid signatures must be obtained from Franklin, Boone, Sebastian, Miller, Garland, Pulaski, Jefferson, and Crittenden counties. The number of signatures is set at 78,133
by July 6, 2012 to be on Nov. 6 ballot. There are mixed views from town to town but petitioners say they shouldn't have any trouble obtaining valid signatures.
Wagering is presently permitted in thoroughbred horseracing at Oaklawn Park in Hot Springs and greyhound racing at Southland Park in West Memphis. The lottery was approved by voters in 2008 to finance college scholarships. The Arkansas Scholarship Lottery began in 2009.
