NO!  I will not remain silent while the Constitution is ignored by our servant government.

NO!  I will not stand by, watching, as one of my countrymen has his Rights trampled.

NO!  I will not carry on my life as though nothing has happened after learning what the IRS and DOJ are doing to Irwin Schiff.

The government didn’t like the tax returns Mr. Schiff filed for 1980-1985. In 1991 the IRS issued a fraudulent assessment against him. By 2001, with penalties and interest, the assessment had risen to over $2 million. In November 2001, the IRS and DOJ filed a civil lawsuit against citizen Schiff, asking the court to order Mr. Schiff to pay the fraudulent assessment which by now has risen to approximately $2.5 million.

The government’s case against Mr. Schiff recently reached the discovery phase. Mr. Schiff filed interrogatories (written questions) with the government’s attorneys as part of the discovery process (his legal right). The core issue of the illegality of the income tax system was raised in Mr. Schiff’s discovery requests.

The government plaintiffs refused to answer Mr. Schiff’s questions. Schiff’s interrogatories included questions such as, "Admit that the phrase ‘voluntary compliance’ cannot mean the same thing as the phrase ‘compulsory compliance’."

During a recent deposition, the government asked Mr. Schiff for his personal and private financial records for 1980-1985. Mr. Schiff responded by saying there was no law that required him to pay the tax and no law that required him to keep records. Schiff also offered to the government that he would waive his Fifth Amendment Right not to be a witness against himself IF the government would show him the specific statute that made him liable for the income tax.  The government refused and Schiff exercised his Fifth Amendment Rights.

In other words, the question of the legality of the income tax system is on trial and, therefore, so is any questionable behavior by citizen Schiff in filing "zero returns" and in telling people they are not liable for the tax.

However, instead of allowing discovery to proceed, unfettered, and according to well established legal procedures culminating in a public jury trial, approximately two dozen armed agents raided Mr. Schiff’s office early on the morning of Tuesday, February 11th, seizing records, legal research, etc. and prevented him from entering his own business.

They handed him what they said was a warrant. It was not signed by a judge and did not have a sworn affidavit attached to it as required by the Fourth Amendment.  In addition, it cites no specific violation of any statute.

The 4^th Amendment to the U.S. Constitution reads as follows:

There now can be no doubt that it was the government’s premeditated intent to ILLEGALLY take Mr. Schiff’s property including computer files and private business records, and to deprive him of his Constitutionally guaranteed right to due process of law.

Not only has the government ignored the law and Mr. Schiff’s unalienable Right to privacy, as guaranteed by the 4^th Amendment, and his Right to due process, as guaranteed by the 5^th and 14^th Amendments, but by disrupting his business and illegally seizing his computers, files and papers, the government has effectively tied Mr. Schiff’s hands behind his back, making it very difficult for Mr. Schiff to win the civil litigation the government initiated against him in 2001. This is a denial of the most fundamental protections of our Constitution.

This is tyranny. An act of tyranny against any American citizen is a threat to the unalienable freedoms of all Americans.

It is time to take a stand. I will do all I can do to correct the wrongs being done to citizen Schiff. I will stand and fight to repel these despotic acts. More on this later.

Due to this development and the likelihood that I will now be joining Mr. Schiff in Nevada in the near future, I see the need to release now, some key elements of our PLAN – elements that I did not intend to release for several days.  Look for this article tomorrow.
